1. Overview

These Terms of Service ("Terms") govern your access to and use of sc0rpia.com (the "Site") and any products purchased through it, operated by sc0rpia ("we," "us," "our"), based in Southern California. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

We reserve the right to update or change these Terms at any time. Changes take effect when posted to this page. Your continued use of the Site after changes are posted constitutes acceptance of those changes.

2. Eligibility

You must be at least 13 years old to use the Site or place an order. If you are under 18 (or the age of majority in your jurisdiction), you may use the Site and place orders only with the involvement and consent of a parent or legal guardian, who is responsible for reviewing and agreeing to these Terms on your behalf and for any orders placed. If you are under 13, a parent or legal guardian must place any order and interact with the Site on your behalf — we do not knowingly allow children under 13 to use the Site directly or to submit their own personal information to us.

By using the Site or placing an order, you represent that you meet these requirements, or that a parent/guardian has reviewed and consented to these Terms and any order on your behalf.

3. Products

We sell apparel (including handmade and/or small-batch items) through the Site. Product descriptions and images are provided as accurately as possible, but we do not warrant that they are entirely error-free, complete, current, or free of typographical errors.

Handmade/small-batch items: Because many items are handmade, made-to-order, or produced in small batches, slight variations in color, print placement, stitching, fabric texture, and sizing between the product photos and the item you receive are normal and expected, and are not considered defects.

We reserve the right to limit quantities, discontinue products, or refuse any order at our discretion.

4. Pricing and Payment

All prices are listed in U.S. Dollars ($USD) and are subject to change without notice. We reserve the right to correct any pricing errors, even after an order has been placed, and will notify you before charging a corrected price.

Payment is processed securely through Shopify's supported payment providers at checkout. By providing payment information, you represent that you are authorized to use the payment method provided.

We are not currently registered to collect sales tax; if that changes, applicable sales tax will be calculated and added at checkout.

5. Orders and Shipping

Once an order is placed, you will receive a confirmation email. We aim to process and ship orders within 3-5 business days, though processing times may vary, particularly for handmade or made-to-order items. Shipping timeframes provided at checkout are estimates only and are not guaranteed.

Risk of loss and title for items purchased pass to you upon our delivery to the shipping carrier. We are not responsible for delays, loss, or damage caused by the shipping carrier once an order has shipped, but we will do our best to assist you in resolving carrier issues.

Please ensure your shipping address is correct at checkout — we are not responsible for orders shipped to an incorrect address provided by the customer.

6. Returns, Exchanges, and Refunds

All sales are final. Please see our Return Policy for complete details. In short: due to the handmade and made-to-order nature of our products, we do not accept returns or exchanges, and all purchases are final sale, except where required by law.

7. Intellectual Property

All content on the Site — including our name, logo, graphics, designs, product photography, and text — is owned by or licensed to sc0rpia and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written permission.

8. User Conduct

When using the Site, you agree not to:

Violate any applicable law or regulation;
Use the Site for any fraudulent or unauthorized purpose;
Attempt to interfere with the security or proper functioning of the Site;
Scrape, copy, or misuse content or data from the Site.

9. Third-Party Links and Services

The Site may contain links to third-party websites or services (e.g., social media, payment processors) that are not owned or controlled by us. We are not responsible for the content, policies, or practices of any third-party sites.

10. Disclaimer of Warranties

The Site and all products are provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except as required by applicable law.

11. Limitation of Liability

To the fullest extent permitted by law, sc0rpia and its owner(s) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Site or purchase of products, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your purchase shall not exceed the amount you paid for the applicable product.

12. Indemnification

You agree to indemnify and hold harmless sc0rpia and its owner(s) from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site or violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any disputes arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in San Diego, California, and you consent to the jurisdiction of such courts.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
